In April 2024, the Supreme People’s Court (SPC) of China issued various statistics relating to intellectual property (IP) disputes in China for 2023. China witnessed a notable surge in 2023 in intellectual property cases across various legal domains, reflecting both the country's growing emphasis on IP protection and the evolving nature of legal disputes in the digital age. Civil IP Cases. First-instance civil IP cases saw significant growth, with courts accepting 462,176 cases, marking a 5.4% increase over 2022. However, second-instance civil IP cases witnessed declines, with a 24.79% decrease in acceptance and a 20.37% decrease in concluded cases compared to the previous year.

Administrative IP Cases. In the realm of administrative IP cases, first-instance cases experienced a slight decline in acceptance but saw a substantial 26.7% increase in concluded cases. Notably, patent cases within this category saw a notable rise of 5.85% year-on-year, indicating a focus on administrative enforcement of patent rights. Second-instance administrative IP cases, on the other hand, witnessed significant increases, with a 54.64% rise in acceptance and a 17.99% increase in concluded cases compared to 2022.

Criminal IP Cases. First-instance criminal IP cases recorded a significant increase of 37.46% in acceptance and a substantial 27.69% rise in concluded cases compared to the previous year. Notably, cases related to trademark and copyright infringement dominated this category, reflecting the challenges posed by counterfeiting and piracy in the digital era. Second-instance criminal IP cases experienced slight declines, with a 2.35% decrease in acceptance and a 1.23% decrease in concluded cases compared to 2022.
